Civil Code Draft and Property Law Reform in China

Abstract: 
The Chinese Government has resolved to complete the Civil Code Draft Bill by 2020. What can we expect from the Draft in reforming the property law, which is a critical component of the Civil Code? Professor Shen will address the debates of the basic principles, different types of usufructuary rights, and most important of all, the creation of new types of property rights for rural land in the Draft. At the same time, in light of the trending of international gurantee system, Professor Shen will also discuss the possible reform of Chinese security interest.
About the Speaker:
Weixing Shen, LLB, LLM, Ph.D. in Law, Professor and Dean of Tsinghua University Law School. Professor Shen joined Tsinghua Law School since 2003. He previously held positions at Jilin University Law School as Associate Professor and at Peking University as Postdoctoral Research Fellow. He has been visiting scholars at University of Cologne, University of Freiburg and Harvard Law School. He is an Executive Council Member of Civil Law Research Association of China Law Society and the Vice President of China’s Legal Education Society. Professor Shen’s research interests include property law, health law and German civil law. He has authored 17 books and over 60 papers. His recent publications include Treatise on Contingent Right (Tsinghua University Press, 2015); Basic Theories of Property Law (China Renmin University Press, 2nd ed. 2016); Legal Reflections on The Dilemma of Organ Donation, in Journal of Finance and Economics, Vol.23, 2012; Reshaping Doctor-Patient Relationship in the Medical Law, in Law Science, 2015, Issue 12.
